Client Care Program

Trust Funding and Maintenance

Trust funding puts your estate plan into effect by coordinating asset ownership and beneficiary designations with your documents. Maintenance keeps those arrangements current as you acquire assets, change beneficiaries, or update your plans. Milvidskiy Law Group P.C. offers assistance with initial funding and ongoing support through our Client Care Program.

Putting Your Trust Into Effect

Signing a trust does not automatically transfer your property to it. Funding may involve deeds, account retitling, assignments of business interests, and beneficiary designation changes. Assets left outside the intended arrangement may pass through probate or to a beneficiary different from the one named in your plan.

We review the assets with you and identify the steps required for each. The appropriate treatment depends on the asset and the terms of your estate plan.

Choosing a Funding Service

Guided Funding

With Guided Funding, you complete the transfers with instructions and support from our team. We explain the required steps, help answer questions from financial institutions, and review the resulting records with you.

Full Funding

With Full Funding, our team takes a more active role in preparing transfer documents and coordinating with financial institutions under a limited power of attorney. We explain what information and signatures are needed from you and track the funding work through review.

Ongoing Maintenance Through the Client Care Program

Funding is an initial step. Ongoing review addresses new assets, changes in family circumstances, and developments in the law. Client Care Program options include:

Continuous Representation

Our firm remains available for estate planning questions and adjustments within the scope of the selected program.

Amendments as Circumstances Change

We review changes prompted by the law or events such as marriage, divorce, a birth, or a death, and prepare appropriate amendments to reflect your decisions.

Annual Meetings

Annual meetings review your documents, assets, and named decision-makers. They also provide an opportunity to identify newly acquired property or accounts that need to be coordinated with the plan.

Coordination With Your Advisers

We work with your financial planners and tax professionals on account ownership, beneficiary designations, and other decisions that affect the estate plan.

Trust Protector Services

A trust protector can provide additional oversight through powers stated in the trust document. Depending on those powers, our role may include reviewing administration, overseeing trustee conduct, making permitted amendments, and helping resolve disputes between trustees and beneficiaries.

We discuss whether a trust protector is appropriate and how that role fits with the trustee’s responsibilities.

Discuss Funding and Ongoing Support

Contact Milvidskiy Law Group P.C. to review your trust’s funding status or discuss maintenance options. We can explain the work needed now, who will handle each step, and which continuing services fit your circumstances.

Frequently Asked Questions

An estate plan reflects your family, your assets, and the law as they stood when you signed it. Over time, people marry, divorce, have children, move, buy and sell property, and open new accounts, while the law changes around them. A plan that is never revisited can end up naming the wrong people, leaving out assets, or relying on rules that no longer apply.

Periodically and after major life events. Many people find a regular check-in helpful because small changes accumulate and are easy to overlook. Our Client Care Program includes annual meetings to review your assets and your plan.

Common triggers include marriage or divorce, the birth or adoption of a child or grandchild, a death or serious illness in the family, a move to another state, buying or selling real estate or a business, opening or closing significant accounts, and changes in the law. Reviewing after these events lets you catch beneficiary designations that no longer fit, assets that were never titled to the trust, and provisions that no longer reflect your wishes.

Retirement accounts, life insurance, and annuities generally pass by beneficiary designation, not under the terms of your trust or will. If a designation names a former spouse, a person who has died, or no one at all, the asset may pass contrary to your plan. Keeping designations coordinated with the trust is a core part of maintaining the plan.

No. A new home, account, or business interest is generally owned in your individual name until it is retitled to the trust or the trust is named as beneficiary, and until then it may need to pass through probate rather than under the trust. Our annual review looks for newly acquired assets that have not been transferred and addresses them.

Whenever a named trustee, successor trustee, agent under a power of attorney, or health care representative has died, become ill, moved far away, or is no longer someone you would choose. Relationships change, and a person who was the right choice years ago may not be today. Fiduciary changes generally require a written amendment or a new document signed with the same formalities as the original.

Through the Client Care Program, we maintain ongoing coordination with your financial planners and tax professionals so estate planning decisions are made with the full picture. For example, if your advisor recommends a new investment, we work together so the new account is titled in the name of your trust. This helps keep your plan and your financial life aligned.

The program includes continuous representation by our firm, regular amendments to your estate plan prompted by changes in the law or significant life events, annual meetings to review your plan and assets, and ongoing coordination with your financial planners and tax professionals. Guided Funding and Full Funding are also available to move assets into your trust. Program options vary, and we will discuss which fits your situation.

A trust protector is a person or firm given specific powers in the trust document to oversee its administration, such as monitoring the trustee, amending certain terms to adapt to changes in law or circumstances, and resolving disputes between trustees and beneficiaries. Milvidskiy Law Group P.C. offers Trust Protector services as an added layer of oversight. Whether a trust protector is appropriate, and which powers to grant, depends on your trust and your goals.

One-time funding moves your existing assets into the trust when the plan is first set up and then ends. Trust maintenance is ongoing: it keeps the plan current as your assets, family, and the law change over time. Funding services address the initial transfer, while the Client Care Program provides the continuing support, amendments, and annual reviews that keep the plan working.

What Our Clients Are Saying

Elena A.

Highly recommend using the services of Milvidskiy Law Group! We were pleased with the level of service, knowledge, and forward thinking. Mr. Milvidskiy offered creative and thoughtful ideas for us. Thank you!

Sal M.

Estate Planning can be a complicated and technical endeavor for most individuals like myself and my wife. In addition, finding a competent Estate Planner can be equally difficult. However, from the outset, we were quickly assured that we had selected the right firm to handle all our Estate needs. Our attorney, Andre, and his assistant, Pamela, emphasized that for a plan to be successful, it must be fully understood and meet all the client’s individual concerns. Technical aspects were explained in layman’s terms, and all our questions were encouraged and fully answered. We’ve had experiences with other law firms, but by far, we found the Milvidskiy Law Group to be professional, trustworthy, experienced in the law, and genuinely interested in their clients’ welfare.

Barbara W.

My husband and I had a very positive experience working with the Milvidskiy Law Group. They were very knowledgeable and professional and an overall pleasure to work with. I strongly recommend using this law firm.

Thomas B.

The Milvidskiy team was incredible, and I am so grateful for their timeliness, compassion, and patience during such a difficult time for our family. During our time at the hospital, many people talked to us instead of speaking with us; however, their legal team was the exception. I am very impressed with how they navigated the tense situation with some of our family members and felt that their empathy was heartwarming. I will be forever grateful for their help ensuring our grandfather’s wishes were listened to and will be honored.

Phoebi L.

Mr. Milvidskiy and his staff are so professional and helpful all the time. I recommend them highly to anyone.

Teresa W.

My experience with the Milvidskiy Law Group was a positive one. They were always available to answer any of my questions. If I did have to leave a message or email a question/concern, they would always respond back in a reasonable amount of time. I would recommend this Law group!

Susan C.

This firm was wonderful, and I highly recommend them. They took the time to explain everything to me as I set up my Estate plan. They answered all my questions and did not pressure me into anything I didn’t want or need. I feel very at ease and relieved that this was taken care of. I also know they remain there if I have any questions down the road. All I have to do is call. Best thing I did this year!!

Rose F.

We were very impressed with the service we received from the Milvidskiy Firm. They were responsive and very professional. They delivered as promised. We highly recommend them! Their fees are quite reasonable.
